Composite Athlete Partner Agreement
Version 1.0 · Effective October 9, 2026
The agreement
This agreement is between Harvey Brands LLC, which owns and operates Composite Athlete ("Composite Athlete", "we", "us"), and you, the person or organization applying to the Composite Athlete Partner Program ("you", "Partner"). You accept it by ticking the box on the application form. It applies once we approve your application. You confirm that you are at least 18 years old and, if you apply for an organization, that you are authorized to accept this agreement for it.
1. What the program is
You recommend Composite Athlete plans to your audience using your own partner link and code. When someone buys through them, we pay you a commission. You are free to say what you honestly think. You are never required to post, and we never pay for positive opinions.
2. Approval
We review every application and may approve or decline it at our discretion. When we approve you, we email you your partner link, your code, and access to the partner portal run by our partner program platform, Tolt.
3. Commissions
Workbooks and programs: 40% of the amount the buyer pays for each workbook or program sold through your link or code.
Athlete Pro: 30% of each Athlete Pro subscription payment from a buyer you refer, for that subscriber's first 12 months of payments.
Coach plans: 30% of each coach plan payment from a coach you refer, for their first 12 months of payments.
Lead Partner: we count your paid sales over the last 30 days, every day. Refunded sales do not count. When you reach 25, we move you to Lead Partner and email you. Lead Partner rates are 50% on workbooks and programs and 40% on Athlete Pro payments. Coach plans stay at 30%. Lead Partner rates apply to sales and subscription payments made from the day of the move. If your count later falls below 25, we may move you back to the standard rates by email, for sales and payments made after that email.
Commissions are calculated on the amount actually paid, after discounts, and excluding sales tax, refunds and chargebacks.
4. How sales are credited
Each sale is credited to one partner only, using these rules in this order:
1. Codes first: if the buyer enters a partner code at checkout, that code's partner gets the credit, whatever links the buyer clicked.
2. Your Composite Athlete click is the first one: if a buyer clicked more than one Composite Athlete partner link in the last 60 days, only the first of those clicks counts. A later partner link does not replace it.
3. Then the most recent paid click wins: we compare that Composite Athlete click with the buyer's clicks on links from affiliate networks we work with (such as Awin) in their own referral window. The most recent of those clicks gets the credit.
Also:
Not commissionable:
• your own purchases, or purchases made on your behalf
• purchases using a code posted somewhere this agreement prohibits
• sales we reasonably believe are fraudulent
Bundles: partner codes cannot be used on bundles. A bundle bought through your link still earns the workbook and program rate.
Our records decide: our records and those of our partner platform decide whether a sale is credited.
5. When and how you are paid
Hold: each commission is held for 30 days so refunds can clear.
Payment: after that, commissions are paid in the monthly payout run once your approved balance reaches $25. Smaller balances carry over to the next month.
Method: payments are made through Tolt to your bank account or PayPal.
Tax forms: before your first payout you must provide a W-9 (US) or W-8 (outside the US). We issue a Form 1099-NEC where US law requires it. You are responsible for your own taxes.
6. Refunds and chargebacks after payment
If a sale is refunded or charged back after you were paid for it, we deduct that commission from your future commissions. We will not ask you to repay a negative balance in cash, unless the sale was self-referred, fraudulent, or came from a breach of this agreement.
7. Free access
While you are an approved partner, we give you free Athlete Pro and access to every Composite Athlete workbook and program, so you can try what you recommend. That access ends if your partnership is paused or ends.
8. How you may promote us
You must:
Disclose clearly. Every post, video, story, email or message that mentions Composite Athlete:
• starts with "Paid partnership with Composite Athlete" or "#ad"
• uses the platform's paid-partnership setting where there is one: Instagram's paid partnership label, YouTube's paid promotion setting, TikTok's content disclosure toggle
• places "I earn a commission if you buy through my link" next to your link
In videos and livestreams, say it out loud, and repeat it during livestreams.
Be truthful. Describe the plans accurately and only share your honest experience.
Follow the law, including the FTC's rules on endorsements and testimonials and anti-spam laws.
You must not:
Claims: promise results, or make weight-loss, fat-loss, injury, medical or health claims about any plan.
Testimonials: use fake, AI-generated, or paid-for-a-positive-review testimonials, or claim results that are not typical.
Brand and trademarks: say or imply you are an official partner of any race, race organizer or brand, or use other companies' trademarks in a way that suggests their endorsement.
Search ads: bid on "Composite Athlete" or any of our product names in search ads.
Coupon sites: post your code on coupon or deal sites.
Spam: send unsolicited bulk messages, or promote us in ways that break any platform's rules.
Children: direct promotions at children under 13.
Self-purchase: buy through your own link or code.
We may review your posts. If something needs fixing, we will tell you, and you agree to fix or remove it promptly.
9. Use of our name and materials
We give you a limited, non-exclusive, revocable permission to use the Composite Athlete name, logo and the materials we provide, only to promote Composite Athlete under this agreement. Do not change our logo or materials, and stop using them when this agreement ends.
10. Pausing and ending the partnership
Either side may end this agreement at any time by email.
When we may pause or end it immediately: if you breach this agreement, harm our reputation, or engage in fraud.
When it is paused or ended:
• your link and codes stop earning
• your free access ends
• your portal access may be limited
Commissions afterwards:
• Commissions for valid sales made before the end are still paid after the 30-day hold. In the final payout we pay any remaining approved balance, even if it is under $25.
• Subscription payments we receive after the end do not earn commission.
• If we end the partnership for breach or fraud, we withhold the commissions connected to that breach or fraud. Other valid commissions are still paid.
11. Changes
We may change the rates or this agreement by emailing you at least 30 days before the change takes effect. Changes never reduce commissions you already earned. If you keep promoting us after a change takes effect, you accept it. If you do not agree, you can end the partnership.
12. Your relationship with us
You are an independent contractor, not our employee, agent or representative, and you cannot make commitments for us. The program is not exclusive. You may promote other products, and we may work with other partners.
13. Data
What you see: you see that a sale you referred happened, its amount and its status. You do not get access to buyers' accounts or their training, nutrition or health data. You may use this sales information only to check your commissions.
How we handle your data: we handle your information as described in our Privacy Policy at compositeathlete.com/privacy.
Your own audience data: you are responsible for following privacy law for any audience data you collect yourself.
14. No earnings promise; limits of liability
No earnings promise: we do not promise any level of sales or earnings.
As-is: the program is provided as-is.
Cap on our liability: to the extent the law allows, our total liability to you under this agreement is limited to the commissions owed to you, and neither side is liable for indirect or consequential losses.
Your indemnity: you agree to cover our losses from claims caused by your content or your breach of this agreement.
15. General
Governing law and courts: North Carolina law governs this agreement. Any dispute goes to the state or federal courts for Forsyth County, North Carolina.
Entire agreement: this is the whole agreement about the Partner Program. It replaces any earlier discussion about the program.
Severability: if part of it is unenforceable, the rest still applies.
